Terms of Use

1. Acceptance

By creating an account or using Foundry ("the Service"), you agree to these Terms. If you do not agree, do not use the Service.

2. What Foundry does

Foundry uses AI to help professionals create and publish social media content, manage client relationships, and run outreach campaigns. Content is generated on your behalf using information you provide. You are responsible for reviewing and approving content before it is published.

3. Your account

  • You must be 18 or older and legally able to enter contracts.
  • You are responsible for maintaining the security of your credentials.
  • One account per person. Do not share accounts.
  • You are responsible for all activity under your account.

4. Acceptable use

You agree not to:

  • Use the Service to generate or publish content that is false, defamatory, harassing, or illegal.
  • Violate any platform's terms of service (Instagram, LinkedIn, etc.) through your use of Foundry.
  • Attempt to reverse-engineer, scrape, or abuse the platform.
  • Use Foundry for spam, bulk unsolicited messaging, or any automated activity not permitted by connected platforms.
  • Misrepresent your identity or impersonate others.

5. AI-generated content

AI-generated content may be inaccurate, incomplete, or inconsistent. You are solely responsible for reviewing, editing, and approving all content before publication. Foundry is not liable for consequences arising from publishing AI-generated content without review.

6. Your content and data

You retain ownership of your content and data. By using Foundry, you grant us a limited license to process your data and content solely to provide the Service. We do not claim ownership of anything you create or upload.

7. Payment and billing

Paid plans are billed in advance. Subscriptions renew automatically. You may cancel at any time; cancellation takes effect at the end of the current billing period. Refunds are not provided for partial periods except where required by applicable law.

8. Termination

We may suspend or terminate your account for violations of these Terms. You may delete your account at any time. Upon termination, your right to use the Service ends immediately, and we will delete your data per our Privacy Policy.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOUNDRY'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID IN THE 12 MONTHS BEFORE THE CLAIM.

11. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

12. Changes

We may update these Terms. We will notify you by email at least 14 days before material changes. Continued use after the effective date constitutes acceptance.
